Conditions of Sale

Confirming purchase orders, if sent, will be governed by the terms and conditions set forth in this catalog. Any acceptance of the offer to sell contained herein is limited to acceptance of these terms. Any proposal for additional or different terms, or any attempt by the customer to vary any of these terms in the customers acceptance by purchase order or otherwise, shall not operate as a rejection of this offer to sell, but shall be deemed acceptance by the customer without those additional or different terms. If this catalog is deemed an acceptance of a prior offer to purchase by customer, then such acceptance is expressly conditioned on customer’s agreement to the terms and conditions set forth in the catalog.

Limitation of Use

Unless otherwise expressly stated, all products listed herein are supplied for research and further manufacturing use only and should not be used for human or animal therapeutic or diagnostic applications.

Terms

Payment terms are net 30 days in US Dollars ($). For domestic orders less than $100, a service charge will be added to the invoice; orders shipping overseas must be $250 or more. Visa and MasterCard are accepted for your convenience.

Shipping

Domestic orders for in-stock items received Monday through Wednesday will ship the next day via air freight or best way F.O.B Rogers,AR. Orders for in-stock items received Thursday and Friday will be shipped the following Monday or Tuesday. Direct international orders are shipped via the best available air freight carrier. For products not in stock at the time of order, please plan on a minimum 2 week lead time – for details, please contact our Customer Service department. Shipping charges are prepaid and added to your invoice unless other arrangements are made when order is placed. All products normally shipped frozen or on wet ice are subject to a per-carton packing carton charge.

Returns

A return authorization is required. There is a 20% restocking fee on all products returned due to customer ordering error.

Guarantee

All products are warranted to meet catalog specifications. Any products not meeting such specifications and returned upon arrival to Pel-Freez within 30 days of shipment will be replaced with like material, or at our option, the purchase price will be refunded. Replacement or refund will not be made for materials rendered defective due to improper storage, alteration, or storage beyond normal shelf life. The foregoing is in lieu of all other warranties, expressed or implied, including implied warranties of merchantability and fitness for a particular purpose. In no event shall Pel-Freez be responsible for lost profits or indirect or consequential damages, including, but not limited to, personal injuries resulting from the use of the products. Pel-Freez guarantees shipments to arrive in proper preserved condition at customer’s first receiving point. Products damaged in transit will be replaced at no charge providing that you have notified the shipping carrier of damages immediately upon receipt and you have contacted Pel-Freez customer service by telephone within two business days of receipt.
